Welcome to TradingM1.com (the “Service”), operated by TradingM1 Inc. (“TradingM1,” “we,” “us,” or “our”). These Terms of Use, Policies, and Disclaimers (“Terms”) govern your access to and use of the Service, including any content, functionality, and services offered on or through TradingM1.com and its associated sites, applications, or features.
By accessing, browsing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. These Terms include a binding arbitration agreement and class action waiver (see Section 26). Unless you opt out within 30 days, disputes will be resolved through binding arbitration rather than in court, except in limited circumstances.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Updated Terms will be posted on this page with the new effective date.

2. Changes to the Service
We may modify, suspend, or discontinue the Service or any features at any time without notice. We do not guarantee backward compatibility for services or APIs.

3. Ownership and License
All rights in the Service, including information, content, market data, charts, alerts, and tools, are owned by TradingM1, its affiliates, or third-party data providers (e.g., exchanges or Interactive Data (IDCO)). Content is licensed solely for personal or internal business display purposes.
Prohibited Uses: You may not use content for automated trading, order generation, price referencing, algorithmic decision-making, risk management, or any non-display processing. You are forbidden from developing or using products, tools, or services that enable such uses, repurpose data, or claim compatibility with prohibited features. No sublicensing, assignment, transfer, sale, or distribution for compensation is allowed without our express written consent. Commercial use of the Service or APIs requires a separate agreement.
Violations may result in legal action, including audits, investigations, account suspension, termination, injunctions, and damages.

4. Prohibition on Reproduction and Redistribution
You are strictly prohibited from reproducing, republishing, redistributing, retransmitting, or otherwise sharing any content, charts, data, snapshots, or materials from TradingM1.com (collectively, “Content”) in any form or medium, including but not limited to websites, blogs, social media, publications, broadcasts, presentations, or educational materials.
Permitted Exception (Attribution Required):
Limited use of static chart snapshots is allowed only for personal, non-commercial, educational, or analytical commentary purposes, provided that:

You include clear, prominent attribution to TradingM1 in the format:
“Chart by TradingM1.com” (font size ≥10 PT, placed directly on or immediately adjacent to the image);
The snapshot is not altered, animated, or used in automated systems;
It is not used for commercial purposes, including paid reports, client presentations, or promotional materials.

Prohibited Actions Include (but are not limited to):

Embedding live charts or widgets outside TradingM1.com;
Rehosting Content on third-party platforms;
Using Content in apps, tools, or services that replicate TradingM1 functionality;
Any form of systematic or bulk downloading, scraping, or extraction.

Violations of this section will result in immediate account termination, permanent IP and device bans, and legal action, including but not limited to cease-and-desist orders, injunctive relief, and claims for damages, lost profits, and legal fees. We actively monitor unauthorized use and enforce this policy without exception.

5. Third-Party Sites and Advertisers
Links to third-party sites are for convenience only. We are not responsible for their content, accuracy, or practices. Your interactions with advertisers are solely between you and them; we disclaim liability for any losses. Unauthorized solicitation is prohibited and may result in bans and legal action.

6. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including accuracy, reliability, timeliness, completeness, or suitability of information. The Service may contain errors, interruptions, or security vulnerabilities; you use it at your own risk. We do not guarantee protection against data loss, viruses, hacking, or interference. Market data from providers may include errors. No warranties apply to third-party content, such as user scripts or indicators.

7. Disclaimer Regarding Investment Decisions and Trading
Trading and investing involve substantial risk of loss and are not suitable for everyone. You should consult a qualified financial advisor before making decisions. TradingM1 does not provide investment advice, recommendations, or guarantees. We are not liable for any losses arising from trading or investing based on Service information, user content, or market data.

8. Disclaimer Regarding Hypothetical Performance Results
Any hypothetical or simulated performance results (e.g., backtests) are for illustrative purposes only and have inherent limitations, including hindsight bias and failure to account for real-world risks like slippage or liquidity. Past performance does not predict future results, and no representation is made that similar outcomes will be achieved in actual trading.

9. Registered Users
Registration is required for certain features. By registering, you represent that you are of legal age, eligible to use the Service, and will provide accurate, up-to-date information. You warrant that any content you upload respects intellectual property rights and does not infringe third-party rights. We may suspend or terminate accounts for breaches and remove violating content.

10. Non-Professional Subscriber Status
Subscribers represent they are non-professionals (personal use only, no advisory roles, own capital). Misrepresentation may result in retroactive charges at professional rates, plus fees; we may invoice accordingly.

11. Derived Data
Certain data is proprietary and derived through secure processes; it is displayed only for non-professional use and cannot be accessed, extracted, or reverse-engineered.

12. Access and Security
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized use. We are not liable for losses due to your security failures.

13. Payment and Cancellation
Subscriptions auto-renew via your chosen method (monthly/annually). A 30-day free trial auto-converts unless canceled. Cancel via your account settings; no refunds for monthly plans, upgrades, or bans. Annual plans offer a 14-day refund window. Market data may incur additional fees. Taxes apply; see our subsidiaries for details. Refunds are subject to verification.

14. Feedback
Any feedback you provide is non-confidential and becomes our property. We may use it without compensation or obligation.

15. Indemnification
You agree to indemnify and hold TradingM1 harmless from claims arising from your content, use of the Service, violations of these Terms, or disputes with other users. You release us from user-user claims.

16. Termination
You may close your account at any time. We may terminate or suspend access without notice for violations, legal requirements, or at our discretion. No refunds upon termination.

17. Emails and Communications
You consent to receive service-related and marketing emails. Unsubscribe via links provided.

18. House Rules
You agree to our House Rules (incorporated herein), which prohibit spam, plagiarism, hate speech, harassment, duplicate accounts, and disruptive behavior. Violations may result in content removal, bans, or legal action. Respect languages of subdomains; English required for script titles/descriptions. Original content only; credit sources.

19. Third-Party Software
The Service may include third-party software governed by their terms. We disclaim warranties for such software.

20. User Scripts and Publications
You warrant IP rights in scripts/publications. You grant us a license to host and display them (default: MPL 2.0). Publications are user opinions, not advice; we disclaim liability. We may remove violating content.

21. Referral Program
Eligible users may earn rewards ($10–$100 per referral) by sharing links. Prohibited: spam, IP misuse. Rewards non-transferable; violations void rewards. Use for subscriptions only.

22. Limitation of Liability
To the fullest extent permitted by law, TradingM1 is not liable for any damages (direct, indirect, incidental, consequential, special, or punitive) arising from use of the Service, content, interruptions, third parties, or violations. Our total liability shall not exceed fees paid in the prior 12 months.

23. Arbitration Agreement
Any disputes shall be resolved by binding arbitration under NAM rules in New York, NY. You waive jury trials and class actions (except small claims or injunctive relief). Opt out within 30 days of acceptance. Governing law: New York (exceptions for EEA users). Claims must be filed within one year.

24. Privacy Policy
Your privacy is important. See our full Privacy Policy for details on data collection, use, and disclosure. We collect personal data (e.g., IP, email) for service provision, analytics, and legal compliance. We may share with affiliates, providers, or authorities as needed. Cookies and third-party trackers (e.g., Google Analytics) are used; opt-outs available.
